Secretly recording conversations

does anyone know, if your going through a divorce. And your spouse is secretly recording your conversations by planting this device in your briefcase, is that legal? Can the audio be used by your spouse for any legal or civil reason? Does she face any repercussions for breaking the law?

I would talk to a lawyer...I hate to be that guy, but asking for legal advice on an escort review site is just asking for trouble...even if somebody claims to be a lawyer, you have no idea if anyone knows what they are talking about.

Also, you didn't confirm if you meant Japan (I assume you do) but the laws are different everywhere and it may matter if the location has an expectation of privacy or not...i.e. are you at a coffee shop where anyone can overhear or your bathroom?

In short, if you are worried, ask a professional.

What @whocares said. Also, even within Japan the law could vary from prefecture to prefecture? Is there a national law covering it?

In the US for example I know that in all states it is legal for me to record a phone call with you. But in some states I have to disclose that I'm recording and obtain your permission, in others I don't have to tell you at all.
 
i know someone who used "illegal" recordings in court against his then wife, so i guess its legal... cant give too many informations though... the recordings proved she cheated and based on that he didnt have to pay...
sad when it comes down to this...

Recording is legal, whether the other party is aware of it or not. We record interactions regularly.

Planting a listening device on a person (or in a room, vehicle etc.) may be regarded as wiretapping, and that is illegal. Talk to a lawyer.
 
I recorded a boss who I suspected was lying to me. At that time, I had found the law saying it was entirely legal to record without consent as long as the malicious intent wasn't made. And often it's admissible as evidence depending on the judge.

I went through a labor issue a few years ago. I consulted a Japanese lawyer and was told it is legal to record the conversation with the Shachou and HR director and that the recording would be admissible in court. English speaking lawyers here if you need one.
